Change or edit header legal

Hi,

I have a short question:

Can I change/edit the Header in sideground.com Themes, because in the licence:
"the logo is a part of the Theme" but what is the logo is it the header ???

As explained in our Terms of Use for the Free Templates (http://www.siteground.com/tos_popup.htm?id=7), you should not modify the link to our website in the footer of the templates nor the company logo residing in the same position. The header elements (images, text, template logo, etc.) can be modified as you see fit.

I made an new header, installt it but the backgorund has a blue bagroundcolor for the header and the content_t.png has a bit blue to.

i changed the files: (look at the Attachment)

-header.jpg
-page_bg.png
-content_t.png

is this right ?
